6. Simplifying Simple Procedure?

The Simple Procedure Rules continue to be subject to interpretation, not least by different courts. This uncertainty can create difficulties for practitioners. The recent decision of Cabot Financial UK Ltd v Gardner and Ors, [2018] SAC (Civ) 12 provided some welcome guidance for practitioners and courts on the Simple Procedure Rules, albeit limited to the subject of undefended action. However a focus of the submissions to the Appeal Court in that case was whether the application of existing legal principles can  provide guidance to courts and users or whether the Simple Procedure Rules represented a significant departure that these principles. The Appeal Court found in the main that the existing legal principles still apply. In light of the decision, this talk looks at how the application of various existing principles can assist practitioners in reducing both the work involved in and the scope for uncertainty in the Simple Procedure Rules.
