Plans: Conflicts and Resolutions 
(Derek Hand)
Derek will look at some of the common issues with plan preparation, discrepancies between title sheets and the OS and will give some practical advice regarding resolving plan issues and title registration.


Rights of Way and Rights to Roam
(Andrew Upton)
This talk will provide an overview of the legal basis underpinning the two rights possessed by members of the public to be on and cross land:- (i) Public Rights of Way; and (ii) Statutory Access Rights under the Land Reform (Scotland) Act 2003. In particular, Andrew will cover:-
  • The requirements for a Right of Way
  • The constitution of a Right of Way
  • The enforcement of a Right of Way
  • The extent and limitations of Access Rights
  • The enforcement of Access Rights


Planning Issues for Conveyancers
(Roslyn MacDonald)

Roslyn will be looking at some of the multitude of planning issues that arise in conveyancing transactions including:-
  • Planning Permission: what constitutes the planning permission, is it the correct permission, and has it been lawfully implemented?
  • Permitted development rights
  • Planning conditions: unduly onerous planning conditions, satisfaction of and compliance with conditions
  • Section 75 agreements – is the purchaser liable for planning obligations?
  • Planning enforcement – have there been any planning breaches and what are the options if there is a suspected planning breach?


Registers of Scotland Update
(Jennifer Henderson)

In this session Jennifer will give an update on what Registers of Scotland achieved in 2018/19, take you through the new five-year corporate plan and provide an update on the arrear, how the land registration completion is progressing and new services provided by Registers of Scotland.


Conference speakers

Derek Hand (Plans Development Manager, First Scottish)
Derek Hand Plans Development Manager at First Scottish. Derek joined First Scottish in 2015, having previously worked for Registers of Scotland since 1983. Derek gained an extensive knowledge of the plans discipline, working closely with both internal and external parties including the Ordnance Survey.
Derek regularly provides advice to clients in - Deed plan preparation; Ordnance Survey map interpretation; Plans reports and adverse answers; Title investigation; Competing Titles and Rectification.

Jennifer Henderson (Keeper, Registers of Scotland)
Jennifer has been the Keeper since April 2018. She is responsible for leading Registers of Scotland and works with the board to set the strategic direction for the organisation. She has been with the Civil Service since 1994; previous roles including – deputy director at the Ministry of Housing, Communities and Local Government and operations director and transformation director at the Defence Science and Technology Laboratory.

Roslyn MacDonald (Harper Macleod LLP)
Roslyn MacDonald is a solicitor at Harper Macleod LLP. She specialises in planning and environmental law and advises a range of clients including planning authorities and developers. Roslyn carries out advisory and transactional work including the drafting and negotiation of Planning Obligation agreements (formerly Section 75 Agreements) and other planning related legal agreements.

Andrew Upton (Partner, Harper Macleod LLP)
Andrew Upton is a Partner in Harper Macleod LLP. He advises and represents clients in relation to all litigious matters, principally contractual and property disputes.
Andrew also sits part-time as a Legal Member of the First-tier Tribunal (Housing and Property Chamber).
