Litigation protective measures – What a general practitioner needs to know and look out for

Practitioners are the first point of contact for clients at times of crisis with their wide range of issues relating to their homes, families and livelihoods. Are we however familiar with all of the remedies that might be open to them and the practical implications of exercising them?

This talk will cover the various protective measures and steps available to clients through the courts, to protect them in a variety of circumstances and situations. It will provide practical advice and guidance as well as real life examples of the benefits and pitfalls.
It will also look at the following measures, discussing what they are, when and how they can be used:
   • Caveats
   • Interim interdict and interim positive orders
   • Diligence on the dependence

The talk will explore situations where general practitioners will find themselves having to advise clients on the use of these measures and the difficulties that can arise if the proper advice is not tendered.
Learning outcomes -
   • Developing understanding of when urgent steps in court proceedings are necessary
   • Updating knowledge on what is open to clients who take their case to court
   • Understanding the risks in omitting to provide advice on these areas
   • Identifying types of client's who's businesses may require this assistance

 

Graham is a Senior Solicitor in Harper Macleod LLP's Dispute Resolution department. He provides advice in relation to a variety of contentious commercial and contractual matters. Graham has extensive experience litigating in the sheriff court around the whole of Scotland, including the commercial court in both Edinburgh and Glasgow. Graham also has significant experience of managing complex cases in the Court of Session.
