Increasingly, beneficiaries are seeking to challenge actions taken by Trustees/Executors in the administration of Trusts/Executry estates. In this webinar John Kerrigan will consider how such disputes might be resolved and what protections Trustees (including Executors) have from challenges to their actions. In what circumstances will a Trustee/Executor be entitled to be indemnified from the Trust/Executry Estate in relation to litigation entered into by the Trustees or defended by them? In what situations are the Court likely to deny Trustees (and Executors) such protections? How do Trustees and Executors protect themselves from allegations of breach of trust?

 

The speaker, John Kerrigan is a Consultant within the Blackadders Private Client Team and has over 40 years of legal practice experience. Currently, John mainly deals with contested Estates and giving Opinions in succession, adults with incapacity, trusts, care and funding for the elderly. John regularly speaks at semiinars throughout Scotland on Succession and AWI topics. He is the author of “Drafting for Succession” now in its second edition and has contributed numerous articles to various Journals and newspapers.
