Applications for guardianship under the Adults with Incapacity Act often reveal underlying family conflicts. Disputes over who should be appointed or re-appointed, the role of nearest relative, or the specific powers of a welfare or financial guardianship order can threaten to obscure and obstruct decision-making which benefits the Adult.

About the Speaker, Sheriff Brian Mohan:
Sheriff Brian Mohan qualified as a solicitor in 1988. For over 25 years he was a solicitor in Lanarkshire, working as a partner in the firm of Cartys until his appointment as a sheriff in 2014.
He was a part-time tutor for 20 years in various courses at both undergraduate level (politics and public law) and in the Diploma in Legal Practice (criminal practice and human rights) at Glasgow University. He completed…
