1. Martha Thomson, Kee solicitors - Section 29 Cohabitation Claims in Estates: A Practical Guide for Private Client Practitioners
This session will consider the practical issues arising when a surviving cohabitant seeks an award from an intestate estate under section 29 of the Family Law (Scotland) Act 2006. It will focus on the matters which executors and private-client practitioners need to identify early: the statutory gateway test, the strict time limit, preserving the relevant evidence, assessing the net intestate estate and competing claims, the court’s discretionary factors, and the significance of benefits falling outside the estate. The session will use practical examples to help practitioners advise both estates and surviving cohabitants with confidence.
