About the Seminar:
This talk will give practitioners invaluable insight into preparation and presentation of Fatal Accident Inquiries under the 2016 Act. The talk will explore the early stages of preparation, all the way through to submissions stage of FAIs, and will include discussion on the approach to the question of reasonable precautions, following Duncan v Lord Advocate earlier this year.
About the Speaker, Emma Toner KC (Compass Chambers):
Emma Toner KC’s principal areas of practice are regulatory crime and Fatal Accident Inquiries in Scotland. She is ranked Band 1 in both Health & Safety and Public & Fatal Accident Inquiries in Chambers UK 2026. Emma is also ranked Band 1 in Crime and Regulatory in Legal 500 2026.
She has extensive experience of cases brought under the Health and Safety at Work Act 1974 and the Road Traffic Act 1988, particularly cases involving fatalities. She is regularly instructed in the High Court…
