About The Event

About the Seminar:

The Prescription (Scotland) Act 2018 came fully into force in February 2025. This seminar will look at some of the key changes in the law, in particular (a) the obligations to which the five-year negative prescription has now been extended; (b) how the 20-year negative prescription has been entirely reformulated so as to operate as a true long-stop prescription; and (c) the (limited) availability of standstill agreements to preserve obligations from the five-year (and two-year) prescriptions.


About the Speaker, David Johnston KC:

David Johnston KC practises at the Scottish Bar mainly in public and commercial law. He is the author of Prescription and Limitation, the second edition of which dates from 2012; he is currently working on a third edition. He was a part-time commissioner of the Scottish Law Commission from 2015-2020 and responsible for the Commission’s project on reform of the law of prescription.
