About the Seminar:

Presentation on Product Liability - Past, Present and Future will explore the essential principles that have emerged from case law under the Consumer Protection Act 1987 focusing on critical aspects such as the meaning of defect, and causation. It will also cover defences and practical tips whilst highlighting the challenges that lie ahead in this area.

 

About the Speaker, Paola Sproul (Digby Brown):

Paola Sproul is a senior solicitor at Digby Brown LLP with extensive experience in handling Product Liability claims; she served as the Principal Solicitor in the case of Hastings -v- Finsbury Orthopaedics Ltd & Anr 2022 UKSC 19. Hastings was the first ruling by the UK Supreme Court on the definition of "defect" under the Consumer Protection Act 1987. She has represented hundreds of victims affected by various product-related issues, including failed PIP breast implants, metal-on-metal hip implants, and the infected blood scandal. Paola is actively involved in advocating for improved safety and regulation of products. She has contributed to the Parliamentary Committee scrutinising the Product Regulation and Metrology Bill (now Act) and is making recommendations to the Law Commission in their review of the existing UK product liability regime. She has co-authored articles on the Product Regulation and Metrology Act 2025 in comparison to reforms being implemented under the new EU’s new Product Liability Directive 2024/2853.
