Sheriff Stuart Reid, one of the commercial sheriffs at Glasgow Sheriff Court, offers further thoughts on the vexed question of prescription, specifically when the running of the prescriptive period can be interrupted. Should a creditor's mere awareness of expenditure incurred by it (which only in hindsight is known to have been wasted), in reliance upon negligent advice, preclude the operation of section 11(3) of the Prescription & Limitation (Scotland) Act 1973? Sheriff Reid looks for guidance to recent case law (Midlothian Council, Gordon's Trustees, WPH Developments Ltd), Tam O'Shanter and Dr Seuss.
