The new judicial review procedure has been in force for nearly 18 months and there are now a number of decisions on the approach which the Court will take to permission to apply for judicial review. What do those practising in this field need to know about the new procedure and how should pleadings be drafted so that they obtain permission or resist it being granted? The new procedure also presents some difficult issues about evidence and productions at the permission stage and the extent to which respondents are under a 'duty of candour'. This seminar will discuss these issues and other recent developments for judicial review.
Denis Edwards is the co-author of Clyde and Edwards on Judicial Review. He is an Advocate and Barrister and has appeared in several leading EU and public law cases in recent years. In addition, he holds a teaching appointment at the Chinese University of Hong Kong.
